You should always file your workers’ compensation claim as quickly as possible. However, under Washington law you have one year from the date of your work injury to file a claim with the Department of Labor and Industries or your self-insured employer. According to RCW 51.08.100, “Injury” means a sudden and tangible happening, of a traumatic nature, producing an immediate or prompt result, and occurring from without, and such physical conditions as result therefrom.

If your injury or conditions develops over time, you have two years from the date of a doctor’s diagnosis for an occupational disease claim to file for workers’ compensation. According to RCW 51.08.140, “Occupational disease” means such disease or infection as arises naturally and proximately out of employment under the mandatory or elective adoption provisions of this title.
